These Terms of Service (“Terms”) govern your access to and use of https://amy-emily.com (the “Site”) and any purchases made through the Site. The Site is operated by Amy & Emily (“we,” “us,” “our”).
By visiting our Site and/or purchasing products from us, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy (collectively, the “Policies”), which are incorporated by reference. If you do not agree to these Terms, you must not use the Site or our services.
1. Eligibility
By using this Site, you confirm that you are at least the age of majority in your province or territory of residence and have the legal capacity to enter into these Terms. 4. Orders & Contract Formation
Placing an order constitutes an offer to purchase. We reserve the right to accept, reject, or cancel orders at our discretion, including in cases of pricing errors, inventory issues, suspected fraud, or shipping limitations.
An order is considered accepted when we send an order confirmation or shipping confirmation email. If an order is canceled after payment has been made, any applicable refund will be issued in accordance with our Return & Refund Policy.
5. Pricing & Payments
All prices are displayed on the Site and may change without notice. Applicable taxes may be added depending on your location and legal requirements.
Payments are processed securely through third-party payment providers. We do not store complete payment card details. By submitting payment information, you represent that you are authorized to use the selected payment method.
6. Shipping, Fulfillment & Delivery
Shipping methods, delivery estimates, costs, and destinations are described in our Shipping Policy.
International fulfillment & dropshipping:
Some or all products may be fulfilled and shipped directly from our international partners and warehouses, including locations in Asia (including China). Delivery timeframes are estimates only and are not guaranteed.
We are not responsible for delays caused by:

Risk of loss passes to the customer upon delivery to the address provided at checkout, to the extent permitted by law.
7. Customs, Duties & Import Fees
For international orders, you may be responsible for customs duties, import taxes, brokerage fees, or other charges imposed by your country. These fees are not included in product prices or shipping costs unless explicitly stated. We have no control over these charges and cannot estimate them in advance.
8. Returns, Refunds & Exchanges
All returns, refunds, and exchanges are governed by our Return & Refund Policy.
Certain items may be non-returnable for hygiene reasons (including earrings, lingerie, and swimwear), except where items arrive damaged or incorrect, as outlined in our Return & Refund Policy.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws.
Orders placed using store credit are eligible for exchange only.
9. Order Cancellations
Order cancellations are handled in accordance with our Return & Refund Policy. Once an order has been processed or shipped, cancellation may not be possible and the order will be subject to the return process where applicable.
10. Account Information
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update it as necessary.
11. Promotions & Discount Codes
Promotions and discount codes are subject to additional terms disclosed at the time of the offer. Unless stated otherwise, discount codes may not be combined and may exclude certain products.
12. User Content
If you submit reviews, comments, or other content (“User Content”), you grant Amy & Emily a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display such content for business and marketing purposes, to the extent permitted by law.
You agree not to submit content that is unlawful, misleading, abusive, defamatory, infringing, or contains malware.

We are not liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, governmental actions, labor disruptions, supply chain interruptions, or carrier delays.
16. Disclaimer of Warranties
The Site and all products and services are provided “as is” and “as available,” to the fullest extent permitted by law. We do not guarantee uninterrupted, secure, or error-free operation of the Site.
Statutory warranties that cannot be excluded under applicable law remain unaffected.
17. Limitation of Liability
To the fullest extent permitted by law, Amy & Emily shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.
Our total liability for any claim relating to the Site or products shall not exceed the amount paid by you for the product(s) giving rise to the claim.
18. Indemnification
You agree to indemnify and hold harmless Amy & Emily, its owners, employees, contractors, and service providers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Site, or violation of any law or third-party rights.

The Site may include links to third-party services or websites. We are not responsible for the content, policies, or practices of third parties. Use of third-party services is at your own risk and subject to their terms.
20. Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of Ontario, Canada, and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the courts located in Ontario, Canada, unless otherwise required by applicable law.
21. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
22. Entire Agreement
These Terms, together with the Policies, constitute the entire agreement between you and Amy & Emily regarding use of the Site and supersede any prior agreements or communications.
